Terms & Conditions
Version 2 · Effective 2026-10-01
- Acceptance and scope — These Terms & Conditions govern access to and use of DoconDuty, a healthcare practice-management platform operated by [confirm full legal name of operator] (“DoconDuty”, “we”, “us” or “our”). The platform may provide features for clinics, hospitals, doctors, front-desk staff, patients, pharmacies and diagnostic laboratories, depending on the subscription and configuration. By creating an account, accessing or using the platform, or accepting these Terms through an applicable process, you agree to these Terms and applicable policies. If you use DoconDuty on behalf of a clinic or organisation, you represent that you are authorised to bind that organisation. If you do not agree, you must not use the relevant service. Mandatory legal rights remain unaffected.
- Nature of the service — DoconDuty provides software tools for practice administration, appointment management, patient records, clinical documentation, prescriptions, billing and other enabled workflows. The features available to a user depend on the account type, permissions, subscription, configuration and applicable service limitations. We may add, modify or discontinue features, subject to applicable law and any contractual commitments. DoconDuty is a technology platform. Unless a specific service agreement expressly states otherwise, we do not ourselves provide medical diagnosis, prescribe medicines, perform clinical examinations or replace a registered healthcare professional.
- Medical responsibility and professional ethics — Healthcare decisions must be made by appropriately qualified and authorised healthcare professionals. Each doctor or practitioner is responsible for exercising independent professional judgment, maintaining applicable registration and qualifications, obtaining informed consent, maintaining confidentiality, keeping appropriate records and complying with applicable professional standards. The platform must not be treated as a substitute for professional medical judgment, physical examination, emergency care or an appropriate referral. A doctor must review patient information and generated documents before relying on them or issuing a prescription, certificate, report or treatment plan. Digital tools, templates, automated calculations and AI-assisted outputs may contain errors or omissions and must be independently checked. Healthcare professionals must not use the platform to prescribe without appropriate assessment, to provide care outside their competence, to misrepresent qualifications, to solicit patients unlawfully or to engage in conduct prohibited by applicable medical ethics rules. Patients must seek emergency assistance through the appropriate local emergency service or healthcare facility rather than relying on DoconDuty's administrative tools or response times.
- Accounts, identity and access — Users must provide accurate information, maintain the confidentiality of credentials and promptly update material changes. Account holders must not impersonate another person, share credentials inappropriately, bypass access controls or permit unauthorised persons to access patient or organisational information. Clinic administrators are responsible for assigning appropriate roles, removing access when staff leave or change responsibilities, and ensuring that their users are authorised to handle the information available to them. We may restrict, suspend or terminate access where reasonably necessary to address security risks, unlawful use, material breaches, non-payment or legal obligations. Where appropriate, we will provide notice and an opportunity to resolve the issue, subject to urgent security and legal requirements.
- Patient information and confidentiality — Users may access, enter or disclose patient information only where they have lawful authority and a legitimate care-related or administrative purpose. Clinics and healthcare professionals are responsible for determining the appropriate patient notices, consents, permissions and record-management practices for their activities. They must not upload information obtained unlawfully or use another patient's records for an unrelated purpose. Users must take reasonable steps to verify patient identity, avoid selecting the wrong patient record, correct errors promptly and ensure that records and prescriptions are reviewed before being relied upon. Access to a record through DoconDuty does not transfer ownership of the underlying clinical relationship or authorise unrestricted disclosure.
- Prescriptions, reports and electronic records — The platform may help users prepare, store, print or transmit clinical documents, depending on available features. The issuing healthcare professional remains responsible for the accuracy, completeness, appropriateness and lawful issuance of every prescription, report, certificate, treatment plan and clinical record. Users must verify patient identity, medicines, dosage, route, frequency, duration, allergies, contraindications and other relevant details before finalising a clinical document. Any electronic signature, digital authentication or professional credential must be used only by its authorised holder and in accordance with applicable law. The platform does not guarantee that every document will satisfy every institution's, regulator's or recipient's formatting or authentication requirements.
- Appointments and patient communications — Appointment availability, booking, cancellation, reminders, queue status and related functions depend on the information entered by users and the configuration of the relevant clinic. Clinics and practitioners are responsible for maintaining accurate schedules and communicating material changes to patients. Patients should contact the clinic directly where an appointment is urgent, unclear or not confirmed. A booking, reminder, notification or queue status is an administrative aid and is not a guarantee of clinical availability, diagnosis, treatment outcome or emergency response.
- AI-assisted and automated features — Where AI-assisted or automated features are offered, their outputs are informational or administrative aids unless the feature is expressly designed and lawfully authorised for another purpose. Outputs may be incomplete, inaccurate, outdated or unsuitable for a particular patient. Users must independently verify them and must not rely on them as the sole basis for clinical diagnosis, prescribing, treatment or emergency decisions. Users must not submit unnecessary identifiable patient information to an AI feature. The use of third-party AI providers, data categories, processing purposes and applicable retention arrangements will be described in the relevant privacy disclosures. We may disable or restrict an AI feature when needed for safety, security, legal compliance or service reliability.
- Subscriptions, fees and payment — Access to paid features may require a subscription or other agreed fee. The applicable plan, price, duration, included features, taxes and payment terms will be communicated through the relevant quotation, invoice, order or subscription screen. Unless a separate written agreement states otherwise, subscriptions are activated or extended after the payment is verified and recorded by the operator. Available payment methods may include bank transfer, cash or another method expressly communicated by DoconDuty. A payment instruction, screenshot or transfer reference does not itself establish payment completion. Users must provide accurate payment details when requested, and DoconDuty may verify the payment before activating or extending service. Automatic renewal, recurring debit and automatic expiry should not be assumed unless expressly disclosed and implemented for the applicable plan. Any taxes or additional charges will be identified as required by law.
- Cancellation, refunds and suspension for non-payment — Subscription cancellation, refund eligibility, refund exclusions and processing procedures are governed by the published Refund & Cancellation Policy and any applicable written service agreement. Unless a written agreement provides otherwise, a cancellation request does not automatically entitle a customer to a refund of fees for a period already supplied. This does not limit rights that cannot lawfully be waived, including remedies for an undelivered service or an incorrect charge where applicable. We may suspend paid functionality after reasonable notice for overdue or unverified payments, subject to applicable law and the relevant contract. We will take reasonable care not to represent an unverified payment as confirmed.
- Acceptable use and prohibited conduct — Users must not: Use DoconDuty for unlawful, fraudulent, deceptive or unauthorised activities. Access, disclose, copy, alter or delete records without permission. Interfere with another user's account or attempt to bypass access controls. Upload malware, exploit vulnerabilities or disrupt the platform. Use the platform to harass, discriminate against, threaten or unlawfully profile individuals. Submit fabricated clinical records, false prescriptions or misleading professional credentials. Use patient data for unauthorised marketing, sale or unrelated commercial purposes. Reverse engineer or copy protected parts of the service except where applicable law permits. Infringe intellectual property, privacy, confidentiality or other rights. Use the service in a manner that compromises patient safety or violates applicable professional standards. We may investigate suspected violations and take proportionate action, including restricting access, preserving relevant records and reporting matters where legally required.
- Data protection and security responsibilities — We handle personal information in accordance with our Privacy Policy and applicable law. Customers and organisational account holders must use appropriate access permissions, maintain confidentiality, provide required notices and obtain any legally required consent for information they submit or process through the platform. Users must promptly notify us of suspected unauthorised access, lost credentials, data exposure or other security incidents affecting their accounts or the service. No party should assume that a platform account eliminates its own legal responsibilities for patient confidentiality, data protection or security.
- Availability, maintenance and support — We aim to provide a reliable service but do not guarantee uninterrupted or error-free operation. Access may be affected by maintenance, network failures, third-party services, security incidents, infrastructure issues or events beyond our reasonable control. Where reasonably practicable, we may provide notice of planned maintenance or material service interruptions. We will use reasonable efforts to restore affected functionality. Customers remain responsible for appropriate clinical continuity arrangements, emergency procedures and any legally required records that must be maintained independently of the platform.
- Intellectual property and user content — The software, branding, design, documentation and other materials supplied by DoconDuty are owned by or licensed to the relevant rights holder and are protected by applicable intellectual-property laws. Subject to these Terms and payment of applicable fees, we grant the customer a limited, non-exclusive, non-transferable right to use the subscribed service for its intended business purposes during the applicable subscription period. Users and customers retain their rights in content they lawfully provide, subject to any rights of patients and other third parties. They grant us only the limited permissions reasonably necessary to host, process, display, back up and transmit that content to provide the service, support the customer and comply with law. Users must not upload content they have no right to use or disclose.
- Third-party services and integrations — The platform may depend on or integrate with third-party services, such as hosting, email, mapping, analytics or AI providers. Those services may have separate terms, availability limitations and privacy practices. We are not responsible for independent third-party services beyond the responsibilities imposed on us by applicable law or an express written agreement. Where an integration is optional, users should review its relevant disclosures before enabling it.
- Disclaimers and limitation of liability — To the extent permitted by law, DoconDuty is provided subject to the limitations and service commitments expressly stated in the applicable subscription or written agreement. We do not guarantee specific clinical outcomes, uninterrupted availability, error-free outputs, compatibility with every device or compliance with every user's independent regulatory obligations. Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law. Any lawful limitation of liability must be proportionate, clear and consistent with applicable consumer-protection requirements. We will not use this clause to remove a healthcare professional's independent clinical duties or a patient's mandatory statutory rights.
- Indemnity — To the extent permitted by law, a business customer may be responsible for losses directly arising from its unlawful use of the service, unauthorised disclosure of information, infringement of third-party rights or material breach of these Terms. Any indemnity must be interpreted subject to applicable law and must not require a patient or individual consumer to waive a non-waivable legal right. Nothing in this section transfers a professional's clinical responsibilities to DoconDuty.
- Suspension and termination — A customer may stop using the service and request cancellation in accordance with the applicable subscription terms. We may suspend or terminate access for material breach, unlawful use, security risks, non-payment or a legal requirement. Where feasible and appropriate, we will provide notice and an opportunity to remedy the issue. Upon termination, access to paid features may cease. The handling, export, retention or deletion of customer and patient information will be governed by applicable law, the Privacy Policy, the service agreement and any legally required retention periods. Customers should arrange any permitted export of their records before termination. We will not promise indefinite data availability after an account has ended unless expressly agreed.
- Changes to the service or these Terms — We may update the service and these Terms to reflect legal, technical, security or business changes. Material changes will be communicated through an appropriate channel where required by law or contract. Where continued use cannot legally constitute acceptance of a material change, we will obtain the required acceptance or provide another appropriate process. The latest published version will identify its effective date. Changes will not retrospectively remove rights that have already accrued where prohibited by law.
- Complaints and dispute resolution — Customers and users may contact [insert verified support or grievance email] to raise a complaint. We will review complaints and respond within the time required by applicable law. These Terms are governed by the laws of India, subject to mandatory legal protections and jurisdictional rules. Any choice of courts or dispute-resolution procedure must be confirmed by the operator and drafted so that it does not unlawfully restrict a consumer's statutory remedies.
- General provisions — If a provision is held unenforceable, the remaining provisions will continue to apply to the extent permitted by law. A failure to enforce a provision immediately does not necessarily waive the right to enforce it later. Users may not transfer their rights or obligations without required authorisation. We may transfer the agreement as part of a lawful business reorganisation, subject to applicable law. These Terms, together with applicable subscription documents and policies, form the agreement governing use of the relevant service. If a written enterprise agreement expressly conflicts with these Terms, the enterprise agreement will govern to the extent stated in it.
